| Y-TDesigns terms and conditions
ACCEPTANCE
When you, the client, ask ‘Y-TDesigns’ to create, develop or modify your
website, or any other form of internet software, you are contracting
with Y-TDesigns under the following terms These terms, referred to as
the ‘Agreement’, indicate you as the ‘Client’ and the work to be
undertaken as ‘the Project’. A copy of these terms and conditions should
be viewed by all new customers at the time of submission of work to Y-TDesigns.
Alternatively, submission of work, payment of an advance fee or final
payment is an acceptance of these Terms and conditions. A copy of these
terms is available via the Y-TDesigns.co.uk website.
PROJECT TIMESCALES
At project acceptance Y-TDesigns will provide an estimated completion date, but cannot always guarantee this date as a final completion date. Y-TDesigns and the Client undertake to work together to complete the Project within the timescale defined at the outset. Y-TDesigns will keep the client updated on project progress and will always endeavour to meet the agreed timescales. Client must also supply all source materials to timescales, failure to do so could result either in a delay to the project, or Y-TDesigns cancelling the Agreement.
QUOTING, DEPOSIT AND PAYMENT
Y-TDesigns will provide a quote for the Project based on information offered from the Client. Quotes are valid for 28 days. A deposit of 50% of the total quoted price may be requested before project commencement, unless otherwise agreed between Y-TDesigns and the Client. Payment terms are 14 days as standard. Any payment returned by the bank will incur a £15 administration charge. This will be invoiced and will be added to the total outstanding debt owed by the customer. A client’s site will be hosted once approval of the design and content is given, however we reserve the right to remove the site at any time until the invoice is paid in full.
ASSIGNMENT
If required, Y-TDesigns reserves the right, and Client agrees to allow
the use of, sub-contractors or agents to work on any aspect of the
Project. Y-TDesigns contracts a third-party to provide all hosting
technology and services, and while every effort is made to ensure the
third party supplier offers the appropriate quality of service,
Y-TDesigns cannot be held responsible for aspects such as server
down-time or engineering faults. The third party’s service level
agreement indicates that all hosting problems will be fixed as quickly
and efficiently as possible.
TECHNOLOGY
Y-TDesigns endeavour to ensure the standard of development is inline
with the latest software and techniques and that this is regularly
reviewed. As the Internet is extremely diverse, we adopt a broad policy
of using the most common technologies supported by the most common of
software applications and operating platforms. Y-TDesigns retains the
right to vary or update these design standards at any time. Y-TDesigns
produce projects where every effort is made to display the pages
acceptably on most popular browsers currently available, however we
cannot accept responsibility for pages which don’t display properly on
versions of browsers released after the project is completed.
COPYRIGHT AND
TRADEMARKS
The Customer retains the copyright to data, files and content provided
by the Customer, and grants Y-TDesigns the rights to publish and use
such material. The Customer must obtain permission and rights to use any
information or files that are copyrighted by a third party. The Customer
is further responsible for granting Y-TDesigns permission and rights for
use of the same and agrees to indemnify and hold harmless Y-TDesigns
from any and all claims resulting from the Customer's negligence or
inability to obtain proper copyright permissions. A contract for Website
design and/or placement shall be regarded as a guarantee by the Customer
to Y-TDesigns that all such permissions and authorities have been
obtained. Any web page; design or entire site designed by
Y-TDESIGNS.co.uk carries a copyright, and cannot be reproduced without
written consent.
CONTENT
Y-TDesigns reserve the right to refuse to include any content on any website that we may judge as unfit due to nature, content or otherwise. This includes, but is not limited to material which could be deemed offensive, or which infringes copyright or are contrary to UK laws.
PERFORMANCE
Y-TDesigns will fix all errors indicated writing within 30 days of the
site being put live on the Internet. If errors are reported after more
than 30 days Y-TDesigns reserves the right to consider this as a new
amendment to the project and apply a standard charge before implementing
any changes. Modifications, extensions or enhancements will be
implemented as necessary upon agreement of the work required and charged
for at the then standard rates, or agreed per change.
DESIGN CREDIT
A link to Y-TDesigns will appear in either small type or by a small graphic at the bottom of the Customer's Web site. If a graphic is used, it will be designed to fit in with the overall site design.
LIMITATION OF LIABILITY
Y-TDesigns does not warrant that the functions contained in these web pages site will meet the customer's requirements or that the operation of the web pages will be uninterrupted or error free. The entire risk as to the quality and performance of the web pages and website is with the customer. In no event will Y-TDesigns be liable to the customer or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate these Web pages or website, even if Y-TDesigns has been advised of the possibility of such damages. Despite the best efforts of Y-TDesigns errors in web page information will occur. At no time will Y-TDesigns responsibilities for accidentally including erroneous information extend beyond correcting the error. We accept no responsibility for poor quality displays of this site or technical problems caused by frames, portals or older machines or equipment. Whilst we aim to ensure that any material, documentations, multi media presentations or executable files downloaded from this website are free of viruses, we would strongly advise that you run your own virus check on any material you download or pages you view whilst visiting this website. We accept no responsibility for any loss of data or system malfunctions experienced while viewing this website.
Although we aim to ensure that all the information contained on this website is correct, we cannot offer any guarantee as to the accuracy of any statement. Our products and services offered on this website are subject to change or withdrawal without prior notice
PRIVACY
Any data collected by Y-TDesigns from clients / customers will be held securely by Y-TDesigns for the purposes of carrying out normal business processes. Such data will not be passed to any third parties. The use of cookies to collect and collate certain information to enable us to provide an improved experience to visitors of this site may be included in site design. If you feel that your privacy has been infringed, or if you have received any unsolicited material from us, please contact us with details of your complaint and will do our best to rectify the situation immediately.
DOMAIN REGISTRATION: Y-TDesigns may, upon agreement, purchase domain names on behalf of the Client. Payment and renewal of those domain names is the responsibility of the Customer, or, if arranged via Y-TDesigns, will be charged via invoice. The loss, cancellation or otherwise of the domain brought about by non or late payment is not the responsibility of Y-TDesigns. The Customer should keep a record of the due dates for payment to ensure that payment is received in good time.
HOSTING AND SITE MANAGEMENT
Y-TDesigns offer
annually renewable packages of hosting and updating service agreements
which can be purchased as part of a package or separately. These include
domain registration, hosting, content updating and on agreement search
engine submissions. The content update service refers to any content,
graphics or text which replaces any current content. It does not extend
to producing new sections or pages unless otherwise noted. Such new
sections or pages should be agreed as a new chargeable project. Quoted
prices generally stay the same year on year but can change depending on
the amount of content updated, additional sections added, band-width or
web space used.
Hosting support and updating packages are renewed annually, invoices are
provided approximately one month before the renewal date, however or
usual payment terms apply from the invoice date.
Customers wishing to cancel a hosting, support or updating package must
inform us before the invoice date otherwise full annual payment will be
required.
No partial refunds will be given for hosting, servicing or updating
packages cancelled during the current agreements time period.
GUARANTEE: In the event that the client is not satisfied with the
design of their site, the Client is entitled to a full refund of the
design fees. Additional charges including but not limited to: stock
photography; electronic commerce software; online transaction processing
solutions; domain name registration; web space; Internet connection
provided by third parties are non refundable.
LAWS
Law: These conditions and all other express terms of contract shall be governed and construed in accordance with the laws of England.
